These Terms of Service (“Terms”) govern your access to and use of PropDolphin (“PropDolphin,” “we,” “us,” or “our”), including the website at propdolphin.com and any related services, features, content, or applications (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 21 years of age to use the Service. By creating an account or accessing the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms.

PropDolphin is an informational tool that provides player prop analysis, statistical data, and odds comparisons for entertainment and informational purposes only. We do not:

• Accept, process, or facilitate wagers of any kind
• Act as a sportsbook, bookmaker, or betting operator
• Guarantee the accuracy of prop lines, odds, or statistical data
• Provide financial, legal, or betting advice
• Process payments for gambling activities

All data, odds, and lines displayed on the Service are provided on an “as-is” basis and may differ from actual sportsbook offerings. Always verify odds and lines directly with your sportsbook before placing any wager.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

PropDolphin may offer free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) unless cancelled. By subscribing, you agree to:

• Pay all applicable fees and taxes associated with your subscription
• Allow us to charge your payment method on a recurring basis until cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by applicable law. We reserve the right to change pricing with reasonable notice.

During beta periods, all features may be available free of charge. Beta access does not constitute a right to permanent free access.

The Service and all content, features, and functionality — including but not limited to text, graphics, logos, icons, images, data compilations, software, and the overall “look and feel” — are owned by PropDolphin or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent, except as necessary to use the Service for its intended purpose.

• Sportsbook names, logos, and brands are the property of their respective owners
• Player names, images, and statistics are used for informational purposes only

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Scrape, data-mine, or otherwise extract data from the Service without authorization
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or other users’ accounts
• Use the Service in connection with any illegal betting or gambling activities
• Impersonate any person or entity, or falsely state or misrepresent your affiliation

The Service may contain links to third-party websites, sportsbooks, and services that are not owned or controlled by PropDolphin. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

Odds, lines, and statistical data displayed on the Service are sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of this data.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, PropDolphin disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any data, odds, or analysis
• Warranties that any errors or defects will be corrected

No advice or information, whether oral or written, obtained from PropDolphin or through the Service shall create any warranty not expressly stated in these Terms.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROPDOLPHIN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, revenue, data, or goodwill
• Losses arising from betting or gambling decisions made based on information from the Service
• Cost of procurement of substitute services
• Any other intangible losses

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim or one hundred dollars ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless PropDolphin and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
